A workplace injury caused by a negligent third party which supplied a motor vehicle, machinery or equipment often results in very serious injuries or death. I am Donald L. Granatstein, Q.C. LL. To be eligible to bring a lawsuit against a negligent third party, you must elect to forgo benefits under the Workplace Safety and Insurance Act. Before electing, you must be reasonably certain you can prove the third party was negligent as you will be forgoing income payments you may need to pay your living costs until the lawsuit is settled.
Potentially, suing a negligent third party can be much more beneficial than collecting WSIB benefits. In the case of an injured worker, for example, on top of damages for pain and suffering, which are much more than WSIB’s Non-Economic Loss award the injured worker could also be entitled to a differential of $50,000 or more a year over his working life expectancy of 20 or 30 years.
The election to sue is made easier if the worker has mortgage, credit card, disability and/or life insurance to cover the family’s living costs until the lawsuit is resolved. Therefore all workers in dangerous jobs should consider protecting their families by purchasing mortgage, credit card, disability and/or life insurance.
Each case of course must be considered on its own merits and legal advice is essential when an election has to be made.
